CNMC’s resolution in the sanctioning procedure against ESCORXADOR COMARCAL DEL MOIANES, S.A. for failure to comply with the obligation to provide the guarantees required by the Electric System Operator SNC/DE/131/22 (20 April 2023)

In its capacity as system operator, RED ELÉCTRICA DE ESPAÑA, S.A. submitted a report to the CNMC regarding possible non-compliance by ESCORXADOR COMARCAL DEL MOIANES with the obligation to provide the guarantees in the amount of 15,000 euros. This amount was requested on 24 February 2022. Following the initiation of a sanctioning procedure, it was declared proven that ESCORXADOR COMARCAL DEL MOIANES did not comply with the initial requirement to provide guarantees, remaining in a state of insufficient guarantees until at least 3 January 2023, these facts constituting a minor offence, typified in article 66.2 of Law 24/2023, of 26 December, on the Electricity Sector. ESCORXADOR COMARCAL DEL MOIANES was fined 54,000 Euros.
