The Directorate General for Consumer Affairs of the Ministry of Health and Families of the Andalusian Regional Government lodged a complaint with the CNMC against Dialoga Servicios Interactivos S.L. (Dialoga) for allegedly failing to comply with the conditions governing the allocation and granting of rights of use of numbering resources. In particular, it was considered that Dialoga could have paid the called subscriber of the 902 numbering, Movelia Tecnologías (Movelia), for the traffic generated towards the aforementioned numbering, through a contract signed by both parties. In this regard, the regulation does not stipulate which services must be provided through this numbering, but expressly prohibits the subscriber (individual or company) contracting the 902 numbering from being paid for the calls made to these numbers. The latter is declared by the CNMC as a proven fact, constituting a serious infringement under article 107.19 of the LGTel, for which a fine of 55,000 euros was imposed.
