CNMC’s resolution in the sanctioning procedure against EÓLICA DE SIERRA MINISTRA, S.L.U., for failure to send information to CNMC pursuant to Circular 5/2009, of 16 July, on accounting and economic and financial information on companies engaged in electricity, natural gas and manufactured gas activities SNC/DE/150/22 (20 April 2023)

Accordingly, to Circular 5/2009 EÓLICA DE SIERRA MINISTRA, S.L.U. is obliged to report information to the CNMC. In view of the lack of the remission of such information by EÓLICA DE SIERRA MINISTRA S,.L., e-mails were sent to the company, pointing out the failure to comply with the deadline for delivery of the information and requesting it to be sent every 15 days. Nevertheless, the company did not answer to the requirement. Following the initiation of a sanctioning procedure, it was declared proven that EÓLICA DE SIERRA MINISTRA did not comply with the initial requirement to submit information, remaining in a state of insufficient information from 30 April 2022 to 29 June 2022, these facts constituting a serious offence, typified in article 65.6 of Law 24/2013, for which a sanction of 1800 euros was imposed (after the application of a 40% reduction for acknowledgement of responsibility and voluntary payment).
