R\u00e9parations des \u00e9l\u00e9ments communs \u00e0 usage privatif."},"content":{"rendered":"<p>Dans de nombreuses communaut\u00e9s de propri\u00e9taires, nous constatons que certains copropri\u00e9taires font usage d\u2019\u00e9l\u00e9ments communs de mani\u00e8re privative.<\/p>\n<p>Dans le cas des terrasses et des cours communs \u00e0 usage privatif surgissent des doutes quant \u00e0 savoir qui doit effectuer les r\u00e9parations qui se produisent dans ces \u00e9l\u00e9ments communs.<\/p>\n<p>Selon la jurisprudence de la Cour de Cassation espagnole (arr\u00eat n\u00b0 80\/2024 du 23 janvier 2024), pour d\u00e9terminer si la r\u00e9paration de la terrasse de l\u2019immeuble \u00e0 usage privatif incombe \u00e0 la communaut\u00e9 de propri\u00e9taires ou au copropri\u00e9taire qui fait usage de cet \u00e9l\u00e9ment, il convient de s\u2019attacher \u00e0 l\u2019origine du dommage, sans que (i) le fait que l\u2019\u00e9l\u00e9ment commun en question ait \u00e9t\u00e9 d\u00e9saffect\u00e9 et soit consid\u00e9r\u00e9 comme \u00e9l\u00e9ment \u00e0 usage privatif, ou (ii) que les statuts \u00e9tablissent l\u2019obligation de r\u00e9paration \u00e0 la charge du copropri\u00e9taire utilisateur, puisse g\u00e9n\u00e9rer automatiquement une responsabilit\u00e9 pour celui-ci.<\/p>\n<p>En ce sens, la Cour de Cassation espagnole a dispos\u00e9, dans le cas des terrasses \u2013 \u00e9l\u00e9ment commun \u00e0 usage privatif \u2013 que si nous sommes en pr\u00e9sence de dommages structurels de l\u2019immeuble, c\u2019est la communaut\u00e9 de propri\u00e9taires qui doit r\u00e9pondre, et que si nous sommes en pr\u00e9sence d\u2019un dommage produit par un d\u00e9faut d\u2019entretien de la terrasse, c\u2019est le copropri\u00e9taire qui fait usage de la terrasse qui doit assumer sa r\u00e9paration ainsi que le dommage caus\u00e9 par celle-ci, car c\u2019est le propri\u00e9taire du logement en question qui a le devoir de soin et de conservation de l\u2019\u00e9l\u00e9ment commun dont l\u2019usage et la jouissance lui sont attribu\u00e9s \u00e0 titre privatif, conform\u00e9ment \u00e0 l\u2019article 9.1, alin\u00e9a b de la Loi espagnole 49\/1960, du 21 juillet, sur la Propri\u00e9t\u00e9 Horizontale ( \u00ab\u00a0<strong>LPH<\/strong> \u00bb). Bien que ladite jurisprudence ne mentionne pas les cours, nous comprenons que le m\u00eame crit\u00e8re leur serait applicable, puisqu\u2019il s\u2019agit d\u2019un cas similaire \u00e0 celui d\u00e9battu par ladite jurisprudence.<\/p>\n<p>Selon la doctrine de la Cour de Cassation espagnole, dans le cas des terrasses sur des toitures, bien que la toiture soit par nature un \u00e9l\u00e9ment commun de l\u2019immeuble et ne puisse \u00eatre privatis\u00e9e (arr\u00eat du 8 avril 2011), les terrasses qui reposent sur ladite toiture font que celle-ci ait une double qualification, car d\u2019une part la toiture est un \u00e9l\u00e9ment commun qui ne peut \u00eatre privatis\u00e9, mais d\u2019autre part la terrasse qui repose sur la toiture peut constituer (i) soit un \u00e9l\u00e9ment privatif, (ii) soit un \u00e9l\u00e9ment \u00e0 usage privatif, selon le cas. Autrement dit, il convient de distinguer entre toiture et \u00ab terrasse sur toiture \u00bb. Cela \u00e9tant, et sans pr\u00e9judice de ce qui a \u00e9t\u00e9 indiqu\u00e9 ci-dessus sur la n\u00e9cessit\u00e9 de s\u2019attacher \u00e0 l\u2019origine des d\u00e9sordres pour d\u00e9terminer la responsabilit\u00e9 de la communaut\u00e9 ou du copropri\u00e9taire, la toiture qui se trouve sous les \u00ab terrasses sur toiture \u00bb est un \u00e9l\u00e9ment commun et il incombe \u00e0 la communaut\u00e9 de propri\u00e9taires d\u2019en assurer la r\u00e9paration en vertu de l\u2019article 10.1 LPH (arr\u00eats du 16\/10\/1989 et du 03\/01\/2007), tandis que les r\u00e9parations des \u00ab terrasses sur toiture \u00bb elles-m\u00eames incombent aux copropri\u00e9taires qui en font usage, en vertu de l\u2019article 9.1, alin\u00e9a b LPH.<\/p>\n<p>En d\u00e9finitive, selon l\u2019endroit o\u00f9 se produit le dommage et\/ou la d\u00e9faillance, une responsabilit\u00e9 sera g\u00e9n\u00e9r\u00e9e soit pour la communaut\u00e9 de propri\u00e9taires, soit pour le copropri\u00e9taire du logement qui fait usage de l\u2019\u00e9l\u00e9ment commun, le tout sans pr\u00e9judice du cas o\u00f9 le dommage serait caus\u00e9 par l\u2019action d\u2019un tiers, auquel cas il conviendrait d\u2019examiner le lien de causalit\u00e9 afin d\u2019\u00e9tablir la responsabilit\u00e9 de l\u2019auteur dudit dommage.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans de nombreuses communaut\u00e9s de propri\u00e9taires, nous constatons que certains copropri\u00e9taires font usage d\u2019\u00e9l\u00e9ments communs de mani\u00e8re privative.
