{"id":3795,"date":"2025-06-04T18:53:53","date_gmt":"2025-06-04T16:53:53","guid":{"rendered":"https:\/\/gavelsabogados.com\/?p=3795"},"modified":"2025-06-04T18:58:34","modified_gmt":"2025-06-04T16:58:34","slug":"procedure-dexpulsion-pour-non-paiement-des-loyers","status":"publish","type":"post","link":"https:\/\/gavelsabogados.com\/fr\/procedure-dexpulsion-pour-non-paiement-des-loyers\/","title":{"rendered":"Proc\u00e9dure d\u2019expulsion pour non-paiement des loyers"},"content":{"rendered":"<p>La proc\u00e9dure d\u2019expulsion pour non-paiement des loyers constitue la voie judiciaire pr\u00e9vue pour permettre au bailleur de recouvrer la possession d\u2019un bien immobilier lorsque le locataire ne respecte pas son obligation de paiement.<\/p>\n<p>\u00c0 titre pr\u00e9alable, il est obligatoire de tenter une r\u00e9solution extrajudiciaire du litige, par des m\u00e9canismes tels que la m\u00e9diation, la conciliation ou l\u2019offre ferme. Cette d\u00e9marche doit \u00eatre justifi\u00e9e par des documents pr\u00e9sent\u00e9s avec la requ\u00eate.<\/p>\n<p>Une fois la demande admise, le greffier du tribunal notifiera au locataire qu\u2019il dispose d\u2019un d\u00e9lai de dix jours ouvrables pour payer la dette, lib\u00e9rer le bien immobilier ou formuler une opposition. Pendant ce m\u00eame d\u00e9lai, le locataire peut exercer le droit d\u2019\u00e9nervation, c\u2019est-\u00e0-dire \u00e9viter l\u2019expulsion en r\u00e9glant l\u2019int\u00e9gralit\u00e9 de la dette r\u00e9clam\u00e9e, y compris les sommes \u00e9chues jusqu\u2019\u00e0 la date du paiement. Pour que l\u2019\u00e9nervation soit admise, le paiement doit \u00eatre effectu\u00e9 au bailleur, consign\u00e9 judiciairement ou notarialement, et satisfaire les conditions pr\u00e9vues \u00e0 l\u2019article 22.4 de la Loi de Proc\u00e9dure Civile. Ce droit ne peut \u00eatre exerc\u00e9 qu\u2019une seule fois pendant la dur\u00e9e du contrat. Si le paiement est correctement effectu\u00e9, la proc\u00e9dure se termine par d\u00e9cret et aucune expulsion n\u2019est prononc\u00e9e. Toutefois, l\u2019\u00e9nervation n\u2019\u00e9teint pas le contrat, et le locataire sera condamn\u00e9 aux frais de justice, sauf s\u2019il prouve que le non-paiement est imputable au bailleur, conform\u00e9ment \u00e0 l\u2019article 22.5 de la Loi de Proc\u00e9dure Civile.<\/p>\n<p>Cela \u00e9tant, conform\u00e9ment \u00e0 la r\u00e9glementation en vigueur, si le bailleur a adress\u00e9 au locataire une mise en demeure de paiement formelle au moins trente jours avant l\u2019introduction de la requ\u00eate, et que le locataire ne s\u2019est pas acquitt\u00e9 des sommes dues, ce dernier perd le droit d\u2019\u00e9nervation. Bien que cette mise en demeure ne soit pas obligatoire, elle produit un effet juridique important, en emp\u00eachant le locataire de conserver la possession du bien par un simple paiement une fois la proc\u00e9dure engag\u00e9e. Elle constitue donc une mesure conseill\u00e9e lorsque le bailleur souhaite exclure l\u2019\u00e9nervation.<\/p>\n<p>Si le locataire formule une opposition, une audience sera convoqu\u00e9e avec production de preuve. Les motifs les plus fr\u00e9quents d\u2019opposition sont le paiement des sommes r\u00e9clam\u00e9es, l\u2019inexistence ou la prescription de la dette, ou encore la nullit\u00e9 ou l\u2019inefficacit\u00e9 du contrat de bail, notamment en cas de vices dans sa formation, absence de titre valable ou manquement du bailleur \u00e0 ses obligations. En l\u2019absence de fondement juridique valable excluant l\u2019obligation de paiement ou faisant obstacle \u00e0 l\u2019expulsion, un jugement faisant droit \u00e0 la demande sera rendu.<\/p>\n<p>Dans les cas o\u00f9 la situation de vuln\u00e9rabilit\u00e9 du locataire est reconnue, la proc\u00e9dure d\u2019expulsion pourra \u00eatre suspendue jusqu\u2019au 31 d\u00e9cembre 2025, conform\u00e9ment aux dispositions du D\u00e9cret-loi royal 1\/2025 du 14 janvier, portant adoption de mesures urgentes en mati\u00e8re \u00e9conomique, de transport, de s\u00e9curit\u00e9 sociale, et pour faire face \u00e0 des situations de vuln\u00e9rabilit\u00e9. Il appartiendra au locataire d\u2019all\u00e9guer et de justifier cette vuln\u00e9rabilit\u00e9.
