Baux des Immeubles Affect\u00e9s \u00e0 Leur Activit\u00e9 Professionnelle Pendant l\u2019\u00c9tat d\u2019Urgence"},"content":{"rendered":"<p class=\"\" data-start=\"4647\" data-end=\"4976\">Suite \u00e0 l\u2019approbation et \u00e0 l\u2019entr\u00e9e en vigueur du <strong data-start=\"4697\" data-end=\"4722\">D\u00e9cret Royal 463\/2020<\/strong>, du <strong data-start=\"4727\" data-end=\"4738\">14 mars<\/strong>, d\u00e9clarant l\u2019\u00e9tat d\u2019urgence pour la gestion de la crise sanitaire provoqu\u00e9e par le COVID-19 (\u00ab <strong data-start=\"4834\" data-end=\"4849\">DR 463\/2020<\/strong> \u00bb), de nombreuses entreprises ont vu leur activit\u00e9 gravement affect\u00e9e, certaines ayant d\u00fb <strong data-start=\"4940\" data-end=\"4961\">cesser totalement<\/strong> leur activit\u00e9.<\/p>\n<p class=\"\" data-start=\"4978\" data-end=\"5516\">Pour att\u00e9nuer les effets de la r\u00e9duction ou de la cessation d\u2019activit\u00e9, le Gouvernement a adopt\u00e9 le <strong data-start=\"5078\" data-end=\"5106\">D\u00e9cret-loi Royal 15\/2020<\/strong>, du <strong data-start=\"5111\" data-end=\"5123\">21 avril<\/strong>, portant mesures urgentes compl\u00e9mentaires de soutien \u00e0 l\u2019\u00e9conomie et \u00e0 l\u2019emploi (\u00ab <strong data-start=\"5207\" data-end=\"5221\">DR 15\/2020<\/strong> \u00bb), entr\u00e9 en vigueur le <strong data-start=\"5246\" data-end=\"5263\">23 avril 2020<\/strong>. Ce d\u00e9cret pr\u00e9voit des mesures sp\u00e9cifiques pour les PME locataires, selon que le bailleur est ou non un <strong data-start=\"5368\" data-end=\"5390\">grand propri\u00e9taire<\/strong> (d\u00e9fini comme poss\u00e9dant plus de dix immeubles, \u00e0 l\u2019exclusion des garages, caves et surfaces construites de plus de 1.500 m\u00b2).<\/p>\n<p class=\"\" data-start=\"5518\" data-end=\"5725\">Ainsi, selon la <strong data-start=\"5534\" data-end=\"5547\">cat\u00e9gorie<\/strong> du bailleur, diff\u00e9rents avantages sont accord\u00e9s aux locataires ayant un bail \u00e0 <strong data-start=\"5627\" data-end=\"5659\">usage autre que d\u2019habitation<\/strong> (locaux ou biens affect\u00e9s \u00e0 l\u2019activit\u00e9 \u00e9conomique du locataire) :<\/p>\n<hr class=\"\" data-start=\"5727\" data-end=\"5730\" \/>\n<p class=\"\" data-start=\"5732\" data-end=\"5780\"><strong data-start=\"5732\" data-end=\"5780\">&#8211; Si le bailleur est un grand propri\u00e9taire :<\/strong><\/p>\n<p class=\"\" data-start=\"5782\" data-end=\"6042\"><strong data-start=\"5782\" data-end=\"5799\">Application :<\/strong> La <strong data-start=\"5803\" data-end=\"5843\">moratoire s\u2019applique automatiquement<\/strong> pendant toute la dur\u00e9e de l\u2019\u00e9tat d\u2019urgence et ses prorogations. Si ce d\u00e9lai est insuffisant au regard de l\u2019impact du COVID-19, la prorogation peut atteindre <strong data-start=\"6001\" data-end=\"6011\">4 mois<\/strong> apr\u00e8s la fin des prorogations.<\/p>\n<p class=\"\" data-start=\"6044\" data-end=\"6167\"><strong data-start=\"6044\" data-end=\"6055\">Effet :<\/strong> Elle prend effet \u00e0 compter du <strong data-start=\"6086\" data-end=\"6111\">loyer mensuel suivant<\/strong> la demande du locataire, <strong data-start=\"6137\" data-end=\"6166\">sans p\u00e9nalit\u00e9 ni int\u00e9r\u00eats<\/strong>.<\/p>\n<p class=\"\" data-start=\"6169\" data-end=\"6427\"><strong data-start=\"6169\" data-end=\"6194\">Paiement des loyers :<\/strong> Les loyers impay\u00e9s seront <strong data-start=\"6221\" data-end=\"6235\">\u00e9chelonn\u00e9s<\/strong> sur une p\u00e9riode de <strong data-start=\"6255\" data-end=\"6267\">deux ans<\/strong>, \u00e0 compter de la fin de l\u2019\u00e9tat d\u2019urgence ou, le cas \u00e9ch\u00e9ant, de la fin des quatre mois suivant cette p\u00e9riode, \u00e0 condition que le bail soit toujours en vigueur.<\/p>\n<p class=\"\" data-start=\"6429\" data-end=\"6621\"><strong data-start=\"6429\" data-end=\"6451\">D\u00e9lai de demande :<\/strong> <strong data-start=\"6452\" data-end=\"6462\">1 mois<\/strong> \u00e0 compter de l\u2019entr\u00e9e en vigueur du DR 15\/2020 (<strong data-start=\"6511\" data-end=\"6528\">23 avril 2020<\/strong>), soit jusqu\u2019au <strong data-start=\"6545\" data-end=\"6560\">23 mai 2020<\/strong>. Une demande hors d\u00e9lai pourra \u00eatre rejet\u00e9e par le bailleur.<\/p>\n<p class=\"\" data-start=\"6623\" data-end=\"6789\"><strong data-start=\"6623\" data-end=\"6636\">Demande :<\/strong> Le locataire doit adresser la demande au bailleur, qui devra l\u2019accepter sauf accord pr\u00e9alable entre les parties sur une r\u00e9duction ou un report du loyer.<\/p>\n<hr class=\"\" data-start=\"6791\" data-end=\"6794\" \/>\n<p class=\"\" data-start=\"6796\" data-end=\"6850\"><strong data-start=\"6796\" data-end=\"6850\">&#8211; Si le bailleur N\u2019EST PAS un grand propri\u00e9taire :<\/strong><\/p>\n<p class=\"\" data-start=\"6852\" data-end=\"7031\"><strong data-start=\"6852\" data-end=\"6869\">Application :<\/strong> Le DR 15\/2020 pr\u00e9voit un <strong data-start=\"6895\" data-end=\"6932\">report temporaire et exceptionnel<\/strong> du paiement des loyers, \u00e0 condition qu\u2019aucun accord volontaire n\u2019ait \u00e9t\u00e9 trouv\u00e9 entre les parties.<\/p>\n<p class=\"\" data-start=\"7033\" data-end=\"7196\"><strong data-start=\"7033\" data-end=\"7044\">Effet :<\/strong> Le DR 15\/2020 ne pr\u00e9cise pas si le report prend effet d\u00e8s le <strong data-start=\"7106\" data-end=\"7122\">mois suivant<\/strong> la demande du locataire ou <strong data-start=\"7150\" data-end=\"7168\">d\u00e8s la demande<\/strong>, incluant le mois en cours.<\/p>\n<p class=\"\" data-start=\"7198\" data-end=\"7493\"><strong data-start=\"7198\" data-end=\"7223\">Paiement des loyers :<\/strong> Le d\u00e9cret ne pr\u00e9cise pas les modalit\u00e9s de remboursement. Il permet toutefois d\u2019utiliser le <strong data-start=\"7315\" data-end=\"7336\">d\u00e9p\u00f4t de garantie<\/strong> pour payer les loyers dus, avec obligation de le <strong data-start=\"7386\" data-end=\"7402\">reconstituer<\/strong> dans un d\u00e9lai d\u2019<strong data-start=\"7419\" data-end=\"7428\">un an<\/strong>, ou durant la dur\u00e9e restante du bail si celle-ci est inf\u00e9rieure.<\/p>\n<p class=\"\" data-start=\"7495\" data-end=\"7667\"><strong data-start=\"7495\" data-end=\"7517\">D\u00e9lai de demande :<\/strong> <strong data-start=\"7518\" data-end=\"7528\">1 mois<\/strong> \u00e0 compter de l\u2019entr\u00e9e en vigueur du DR 15\/2020, soit jusqu\u2019au <strong data-start=\"7591\" data-end=\"7606\">23 mai 2020<\/strong>. Une demande hors d\u00e9lai pourra \u00eatre rejet\u00e9e par le bailleur.<\/p>\n<hr class=\"\" data-start=\"7669\" data-end=\"7672\" \/>\n<p class=\"\" data-start=\"7674\" data-end=\"7758\">Ces deux sc\u00e9narios ne s\u2019appliquent qu\u2019aux PME remplissant les conditions suivantes :<\/p>\n<p class=\"\" data-start=\"7760\" data-end=\"8011\"><strong data-start=\"7760\" data-end=\"7766\">A)<\/strong> Respecter les seuils de l\u2019<strong data-start=\"7793\" data-end=\"7810\">article 257.1<\/strong> du <strong data-start=\"7814\" data-end=\"7848\">D\u00e9cret L\u00e9gislatif Royal 1\/2010<\/strong>, du <strong data-start=\"7853\" data-end=\"7866\">2 juillet<\/strong>, portant refonte de la <strong data-start=\"7890\" data-end=\"7926\">Loi sur les Soci\u00e9t\u00e9s de Capitaux<\/strong>, \u00e0 savoir remplir deux des conditions suivantes pendant deux exercices cons\u00e9cutifs :<\/p>\n<ul data-start=\"8014\" data-end=\"8158\">\n<li class=\"\" data-start=\"8014\" data-end=\"8059\">\n<p class=\"\" data-start=\"8016\" data-end=\"8059\">Total de l\u2019actif \u2264 <strong data-start=\"8035\" data-end=\"8057\">4 millions d\u2019euros<\/strong> ;<\/p>\n<\/li>\n<li class=\"\" data-start=\"8062\" data-end=\"8120\">\n<p class=\"\" data-start=\"8064\" data-end=\"8120\">Chiffre d\u2019affaires net annuel \u2264 <strong data-start=\"8096\" data-end=\"8118\">8 millions d\u2019euros<\/strong> ;<\/p>\n<\/li>\n<li class=\"\" data-start=\"8123\" data-end=\"8158\">\n<p class=\"\" data-start=\"8125\" data-end=\"8158\">Effectif moyen \u2264 <strong data-start=\"8142\" data-end=\"8157\">50 salari\u00e9s<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"8160\" data-end=\"8227\"><strong data-start=\"8160\" data-end=\"8166\">B)<\/strong> Que leur activit\u00e9 ait \u00e9t\u00e9 suspendue en vertu du DR 463\/2020.<\/p>\n<p class=\"\" data-start=\"8229\" data-end=\"8485\"><strong data-start=\"8229\" data-end=\"8235\">C)<\/strong> Si leur activit\u00e9 n\u2019a pas \u00e9t\u00e9 directement suspendue par le DR 463\/2020, les PME ayant subi une <strong data-start=\"8330\" data-end=\"8362\">baisse de chiffre d\u2019affaires<\/strong> de <strong data-start=\"8366\" data-end=\"8374\">75 %<\/strong> par rapport \u00e0 la moyenne mensuelle du trimestre correspondant de l\u2019ann\u00e9e pr\u00e9c\u00e9dente peuvent acc\u00e9der au report.<\/p>\n<p class=\"\" data-start=\"8487\" data-end=\"8639\">En tout \u00e9tat de cause, la loi n\u2019emp\u00eache pas les parties de conclure tout <strong data-start=\"8560\" data-end=\"8576\">autre accord<\/strong> plus avantageux ou plus adapt\u00e9 aux circonstances du locataire.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Suite \u00e0 l\u2019approbation et \u00e0 l\u2019entr\u00e9e en vigueur du D\u00e9cret Royal 463\/2020, du 14 mars, d\u00e9clarant l\u2019\u00e9tat d\u2019urgence pour la gestion de la crise sanitaire provoqu\u00e9e par le COVID-19 (\u00ab DR 463\/2020 \u00bb), de nombreuses entreprises ont vu leur activit\u00e9 gravement affect\u00e9e, certaines ayant d\u00fb cesser totalement leur activit\u00e9.
