{"id":3742,"date":"2017-12-15T11:01:49","date_gmt":"2017-12-15T10:01:49","guid":{"rendered":"https:\/\/gavelsabogados.com\/?p=3742"},"modified":"2025-04-22T21:30:36","modified_gmt":"2025-04-22T19:30:36","slug":"contrats-de-pret-avec-garantie-hypothecaire","status":"publish","type":"post","link":"https:\/\/gavelsabogados.com\/fr\/contrats-de-pret-avec-garantie-hypothecaire\/","title":{"rendered":"Contrats de Pr\u00eat avec Garantie Hypoth\u00e9caire"},"content":{"rendered":"<p class=\"\" data-start=\"3945\" data-end=\"4204\">Les <strong data-start=\"3949\" data-end=\"3971\">premiers jugements<\/strong> rendus par les tribunaux sp\u00e9cifiquement d\u00e9sign\u00e9s pour conna\u00eetre des litiges entre particuliers et \u00e9tablissements bancaires, relatifs aux <strong data-start=\"4109\" data-end=\"4133\">conditions g\u00e9n\u00e9rales<\/strong> contenues dans les <strong data-start=\"4153\" data-end=\"4186\">contrats de pr\u00eat hypoth\u00e9caire<\/strong>, ont \u00e9t\u00e9 publi\u00e9s.<\/p>\n<p class=\"\" data-start=\"4206\" data-end=\"4988\">L\u2019<strong data-start=\"4208\" data-end=\"4233\">Accord du 25 mai 2017<\/strong> de la <strong data-start=\"4240\" data-end=\"4306\">Commission Permanente du Conseil G\u00e9n\u00e9ral du Pouvoir Judiciaire<\/strong>, attribuant comp\u00e9tence exclusive, mais non excluante, \u00e0 certains tribunaux, chacun avec une comp\u00e9tence territoriale d\u00e9termin\u00e9e, pour conna\u00eetre des litiges relatifs aux <strong data-start=\"4475\" data-end=\"4499\">conditions g\u00e9n\u00e9rales<\/strong> dans les <strong data-start=\"4509\" data-end=\"4582\">contrats de financement garantis par des s\u00fbret\u00e9s r\u00e9elles immobili\u00e8res<\/strong> dont l\u2019emprunteur est une personne physique (l\u2019\u00ab Accord \u00bb), a \u00e9t\u00e9 publi\u00e9 au <strong data-start=\"4659\" data-end=\"4685\">Journal Officiel (BOE)<\/strong> le <strong data-start=\"4689\" data-end=\"4704\">27 mai 2017<\/strong>. Cet accord a d\u00e9sign\u00e9 <strong data-start=\"4727\" data-end=\"4743\">54 tribunaux<\/strong> pour r\u00e9soudre les litiges entre particuliers poss\u00e9dant une hypoth\u00e8que sur leur logement et les banques, concernant notamment les <strong data-start=\"4873\" data-end=\"4893\">clauses plancher<\/strong> ou les <strong data-start=\"4901\" data-end=\"4935\">clauses de frais hypoth\u00e9caires<\/strong> li\u00e9s \u00e0 la constitution, la novation ou l\u2019annulation.<\/p>\n<p class=\"\" data-start=\"4990\" data-end=\"5487\">Cette mesure a permis d\u2019obtenir une <strong data-start=\"5026\" data-end=\"5055\">unification des d\u00e9cisions<\/strong> judiciaires. Avant l\u2019entr\u00e9e en vigueur de l\u2019Accord, les d\u00e9cisions des tribunaux divergeaient, certains accordant la restitution <strong data-start=\"5184\" data-end=\"5197\">int\u00e9grale<\/strong> des frais hypoth\u00e9caires, d\u2019autres seulement <strong data-start=\"5242\" data-end=\"5255\">partielle<\/strong>. Ce contexte se caract\u00e9risait par :<br data-start=\"5291\" data-end=\"5294\" \/>(i) une <strong data-start=\"5302\" data-end=\"5326\">ins\u00e9curit\u00e9 juridique<\/strong> quant au tribunal comp\u00e9tent, et<br data-start=\"5358\" data-end=\"5361\" \/>(ii) une <strong data-start=\"5370\" data-end=\"5388\">discrimination<\/strong> des demandeurs recevant des d\u00e9cisions diff\u00e9rentes pour des cas identiques selon le tribunal saisi.<\/p>\n<p class=\"\" data-start=\"5489\" data-end=\"5687\">D\u00e9sormais, le r\u00e9sultat d\u2019une proc\u00e9dure concernant la <strong data-start=\"5542\" data-end=\"5553\">nullit\u00e9<\/strong> de la clause de frais de constitution, novation ou annulation, ainsi que la <strong data-start=\"5630\" data-end=\"5645\">restitution<\/strong> des montants pay\u00e9s, est <strong data-start=\"5670\" data-end=\"5686\">pr\u00e9d\u00e9termin\u00e9<\/strong>.<\/p>\n<p class=\"\" data-start=\"5689\" data-end=\"5935\">La jurisprudence actuelle a unifi\u00e9 sa position, consid\u00e9rant que l\u2019action visant \u00e0 d\u00e9clarer la nullit\u00e9 de la clause attribuant tous les frais de constitution au d\u00e9biteur, ainsi que l\u2019action <strong data-start=\"5878\" data-end=\"5892\">accessoire<\/strong> de restitution, sont <strong data-start=\"5914\" data-end=\"5934\">imprescriptibles<\/strong>.<\/p>\n<p class=\"\" data-start=\"5937\" data-end=\"5968\">Les frais r\u00e9cup\u00e9rables sont :<\/p>\n<ul data-start=\"5969\" data-end=\"6217\">\n<li class=\"\" data-start=\"5969\" data-end=\"6024\">\n<p class=\"\" data-start=\"5971\" data-end=\"6024\">les <strong data-start=\"5975\" data-end=\"5995\">frais de notaire<\/strong> li\u00e9s au pr\u00eat hypoth\u00e9caire,<\/p>\n<\/li>\n<li class=\"\" data-start=\"6025\" data-end=\"6077\">\n<p class=\"\" data-start=\"6027\" data-end=\"6077\">les <strong data-start=\"6031\" data-end=\"6054\">frais d\u2019inscription<\/strong> au registre foncier,<\/p>\n<\/li>\n<li class=\"\" data-start=\"6078\" data-end=\"6130\">\n<p class=\"\" data-start=\"6080\" data-end=\"6130\">les <strong data-start=\"6084\" data-end=\"6104\">frais de gestion<\/strong>, impos\u00e9s par la banque,<\/p>\n<\/li>\n<li class=\"\" data-start=\"6131\" data-end=\"6217\">\n<p class=\"\" data-start=\"6133\" data-end=\"6217\">les <strong data-start=\"6137\" data-end=\"6158\">frais d\u2019expertise<\/strong>, si l\u2019\u00e9valuation a \u00e9t\u00e9 r\u00e9alis\u00e9e \u00e0 la demande de la banque.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"6219\" data-end=\"6429\">Les tribunaux estiment que les <strong data-start=\"6250\" data-end=\"6270\">frais de notaire<\/strong> incombent au pr\u00eateur, car c\u2019est dans son int\u00e9r\u00eat, conform\u00e9ment au <strong data-start=\"6337\" data-end=\"6363\">D\u00e9cret Royal 1926\/1989<\/strong>, du <strong data-start=\"6368\" data-end=\"6383\">17 novembre<\/strong>, et \u00e0 l\u2019<strong data-start=\"6392\" data-end=\"6428\">article 63 du R\u00e8glement Notarial<\/strong>.<\/p>\n<p class=\"\" data-start=\"6431\" data-end=\"6638\">Concernant les <strong data-start=\"6446\" data-end=\"6469\">frais d\u2019inscription<\/strong>, comme c\u2019est la banque qui sollicite l\u2019inscription, elle doit en assumer les co\u00fbts, selon l\u2019<strong data-start=\"6562\" data-end=\"6617\">Annexe II, r\u00e8gle huiti\u00e8me du D\u00e9cret Royal 1427\/1989<\/strong>, du <strong data-start=\"6622\" data-end=\"6637\">17 novembre<\/strong>.<\/p>\n<p class=\"\" data-start=\"6640\" data-end=\"6887\">Pour les <strong data-start=\"6649\" data-end=\"6669\">frais de gestion<\/strong>, le principe est que c\u2019est celui qui en b\u00e9n\u00e9ficie qui les paie. Or, la banque impose souvent le choix du gestionnaire, sans consulter l\u2019emprunteur, contrevenant \u00e0 l\u2019<strong data-start=\"6835\" data-end=\"6870\">article 40 du D\u00e9cret-Loi 6\/2000<\/strong>, du <strong data-start=\"6875\" data-end=\"6886\">23 juin<\/strong>.<\/p>\n<p class=\"\" data-start=\"6889\" data-end=\"7207\">Les <strong data-start=\"6893\" data-end=\"6914\">frais d\u2019expertise<\/strong> doivent \u00e9galement \u00eatre pay\u00e9s par la banque, l\u2019\u00e9valuation \u00e9tant exig\u00e9e par elle pour formaliser l\u2019hypoth\u00e8que et utile en cas de saisie (<strong data-start=\"7050\" data-end=\"7095\">article 682 de la Loi de Proc\u00e9dure Civile<\/strong>) ; elle d\u00e9termine aussi le montant du pr\u00eat, conform\u00e9ment \u00e0 la <strong data-start=\"7158\" data-end=\"7172\">Loi 2\/1981<\/strong>, du <strong data-start=\"7177\" data-end=\"7188\">25 mars<\/strong> (<strong data-start=\"7190\" data-end=\"7205\">article 5.2<\/strong>).<\/p>\n<p class=\"\" data-start=\"7209\" data-end=\"7453\">Enfin, contrairement \u00e0 l\u2019arr\u00eat de la <strong data-start=\"7246\" data-end=\"7262\">Cour Supr\u00eame<\/strong> du <strong data-start=\"7266\" data-end=\"7286\">23 d\u00e9cembre 2015<\/strong>, le paiement de l\u2019<strong data-start=\"7305\" data-end=\"7356\">Imp\u00f4t sur les Actes Juridiques Document\u00e9s (AJD)<\/strong> revient \u00e0 l\u2019emprunteur, conform\u00e9ment \u00e0 l\u2019<strong data-start=\"7398\" data-end=\"7437\">article 68 du D\u00e9cret Royal 828\/1995<\/strong>, du <strong data-start=\"7442\" data-end=\"7452\">29 mai<\/strong>.<\/p>\n<p class=\"\" data-start=\"7455\" data-end=\"7661\">En r\u00e9sum\u00e9, selon la jurisprudence actuelle, l\u2019emprunteur peut r\u00e9clamer \u00e0 la banque les <strong data-start=\"7542\" data-end=\"7557\">frais pay\u00e9s<\/strong> pour la constitution, novation et annulation de l\u2019hypoth\u00e8que : notaire, registre, gestion et expertise.<\/p>\n<hr class=\"\" data-start=\"7663\" data-end=\"7666\" \/>\n<p class=\"\" data-start=\"7668\" data-end=\"7747\">\n","protected":false},"excerpt":{"rendered":"<p>Les premiers jugements rendus par les tribunaux sp\u00e9cifiquement d\u00e9sign\u00e9s pour conna\u00eetre des litiges entre particuliers et \u00e9tablissements bancaires, relatifs aux conditions g\u00e9n\u00e9rales contenues dans les contrats de pr\u00eat hypoth\u00e9caire, ont \u00e9t\u00e9 publi\u00e9s.
