{"id":3712,"date":"2022-03-28T10:16:11","date_gmt":"2022-03-28T08:16:11","guid":{"rendered":"https:\/\/gavelsabogados.com\/?p=3712"},"modified":"2025-04-22T14:16:15","modified_gmt":"2025-04-22T12:16:15","slug":"depenses-ordinaires-dans-un-contrat-de-location-de-logement","status":"publish","type":"post","link":"https:\/\/gavelsabogados.com\/fr\/depenses-ordinaires-dans-un-contrat-de-location-de-logement\/","title":{"rendered":"D\u00e9penses ordinaires dans un contrat de location de logement"},"content":{"rendered":"<p class=\"\" data-start=\"3461\" data-end=\"3706\">Nous allons aborder un sujet r\u00e9ellement complexe, qui donne lieu \u00e0 de nombreuses discussions dans le domaine des baux urbains d\u2019habitation : la question de savoir \u00e0 qui incombe la prise en charge du co\u00fbt des r\u00e9parations dans les logements lou\u00e9s.<\/p>\n<p class=\"\" data-start=\"3708\" data-end=\"3935\">Comme l\u2019\u00e9tablit l\u2019article 21.4 de la Loi 29\/1994 du 24 novembre sur les Baux Urbains (la \u00ab LAU \u00bb) :<br data-start=\"3807\" data-end=\"3810\" \/><strong data-start=\"3810\" data-end=\"3935\">\u00ab Les petites r\u00e9parations exig\u00e9es par l\u2019usure r\u00e9sultant de l\u2019usage ordinaire du logement sont \u00e0 la charge du locataire. \u00bb<\/strong><\/p>\n<p class=\"\" data-start=\"3937\" data-end=\"4464\">Autrement dit, les petits dommages dus \u00e0 l\u2019usage ordinaire du logement qui apparaissent pendant la dur\u00e9e du contrat doivent \u00eatre r\u00e9par\u00e9s aux frais du locataire. Pour cela, plusieurs conditions doivent \u00eatre r\u00e9unies : (i) qu\u2019il s\u2019agisse bien de r\u00e9parations, (ii) qu\u2019il s\u2019agisse de r\u00e9parations ou de remplacements mineurs. En ce qui concerne leur montant, certains jugements consid\u00e8rent comme \u00ab petite r\u00e9paration \u00bb toute r\u00e9paration inf\u00e9rieure \u00e0 150 euros ; (iii) qu\u2019elles r\u00e9sultent de l\u2019usure li\u00e9e \u00e0 l\u2019usage ordinaire du logement.<\/p>\n<p class=\"\" data-start=\"4466\" data-end=\"4708\">La limite se trouve dans la nature du bien affect\u00e9, car le bailleur est tenu de r\u00e9aliser les r\u00e9parations n\u00e9cessaires pour maintenir le logement dans des conditions d\u2019habitabilit\u00e9 pour l\u2019usage convenu, conform\u00e9ment \u00e0 l\u2019article 21.1 de la LAU :<\/p>\n<p class=\"\" data-start=\"4710\" data-end=\"5021\"><strong data-start=\"4710\" data-end=\"5021\">\u00ab Le bailleur est tenu de r\u00e9aliser, sans droit d\u2019augmenter le loyer pour cela, toutes les r\u00e9parations n\u00e9cessaires pour conserver le logement en \u00e9tat d\u2019habitabilit\u00e9 pour servir \u00e0 l\u2019usage convenu, sauf si la d\u00e9t\u00e9rioration \u00e0 r\u00e9parer est imputable au locataire selon les articles 1.563 et 1.564 du Code Civil. \u00bb<\/strong><\/p>\n<p class=\"\" data-start=\"5023\" data-end=\"5444\">Ainsi, lorsqu\u2019il s\u2019agit de r\u00e9parations affectant l\u2019habitabilit\u00e9 du logement, non imputables au locataire, c\u2019est au bailleur qu\u2019il revient de les assumer, ind\u00e9pendamment de leur montant, comme le pr\u00e9voit l\u2019article 1.554.2 du Code Civil, selon lequel le bailleur est tenu :<br data-start=\"5294\" data-end=\"5297\" \/><strong data-start=\"5297\" data-end=\"5444\">\u00ab De faire pendant la dur\u00e9e du bail toutes les r\u00e9parations n\u00e9cessaires pour le maintenir en \u00e9tat de servir \u00e0 l\u2019usage auquel il a \u00e9t\u00e9 destin\u00e9. \u00bb<\/strong><\/p>\n<p class=\"\" data-start=\"5446\" data-end=\"5510\">\u00c0 titre illustratif, voici quelques d\u00e9cisions de nos tribunaux :<\/p>\n<ul data-start=\"5512\" data-end=\"6365\">\n<li class=\"\" data-start=\"5512\" data-end=\"5882\">\n<p class=\"\" data-start=\"5514\" data-end=\"5882\"><strong data-start=\"5514\" data-end=\"5579\">Arr\u00eat de la Cour Provinciale de Pontevedra du 31 octobre 2011<\/strong>, qui a estim\u00e9 qu\u2019apr\u00e8s une location de 7 ans, un appartement devait \u00eatre repeint et que le bailleur devait en assumer les frais. En revanche, les r\u00e9parations telles que la r\u00e9paration d\u2019une chasse d\u2019eau, le changement de robinets, ou le d\u00e9bouchage d\u2019une baignoire devaient \u00eatre \u00e0 la charge du locataire.<\/p>\n<\/li>\n<li class=\"\" data-start=\"5883\" data-end=\"6170\">\n<p class=\"\" data-start=\"5885\" data-end=\"6170\"><strong data-start=\"5885\" data-end=\"5959\">Arr\u00eat de la Cour Provinciale de Santa Cruz de Tenerife du 29 mars 2004<\/strong>, qui a \u00e9tabli que le remplacement des portes, d\u2019un chauffe-eau \u00e0 gaz, d\u2019un matelas et d\u2019un sommier devait \u00eatre support\u00e9 par le locataire, ces r\u00e9parations n\u2019\u00e9tant pas n\u00e9cessaires pour l\u2019habitabilit\u00e9 du logement.<\/p>\n<\/li>\n<li class=\"\" data-start=\"6171\" data-end=\"6365\">\n<p class=\"\" data-start=\"6173\" data-end=\"6365\"><strong data-start=\"6173\" data-end=\"6230\">Arr\u00eat de la Cour Provinciale de Burgos du 3 mars 2006<\/strong>, qui a statu\u00e9 que les r\u00e9parations du chauffage, de l\u2019installation d\u2019eau et de la chasse d\u2019eau devaient \u00eatre assum\u00e9es par le locataire.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"6367\" data-end=\"6478\">En outre, nos tribunaux ont estim\u00e9 que les r\u00e9parations suivantes relevaient de la responsabilit\u00e9 du locataire :<\/p>\n<ul data-start=\"6480\" data-end=\"6936\">\n<li class=\"\" data-start=\"6480\" data-end=\"6577\">\n<p class=\"\" data-start=\"6482\" data-end=\"6577\">Dommages \u00e9lectriques, tels que ampoules, douilles, tubes fluorescents, prises et interrupteurs.<\/p>\n<\/li>\n<li class=\"\" data-start=\"6578\" data-end=\"6831\">\n<p class=\"\" data-start=\"6580\" data-end=\"6831\">Dommages de plomberie, comme les chasses d\u2019eau, les robinets et le d\u00e9bouchage des tuyaux. Il s\u2019agit de dommages concernant des \u00e9l\u00e9ments d\u2019usage quotidien ou r\u00e9sultant pr\u00e9cis\u00e9ment de cet usage, \u00e0 l\u2019exclusion de ceux concernant l\u2019installation elle-m\u00eame.<\/p>\n<\/li>\n<li class=\"\" data-start=\"6832\" data-end=\"6936\">\n<p class=\"\" data-start=\"6834\" data-end=\"6936\">Dommages aux \u00e9quipements, tels que la casse de sommiers, de stores, de serrures ou de vitres de porte.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"6938\" data-end=\"7241\">Cela dit, compte tenu de l\u2019infinit\u00e9 de cas pouvant r\u00e9sulter de l\u2019usage quotidien d\u2019un logement, les d\u00e9cisions judiciaires existantes \u00e0 ce sujet sont tout aussi nombreuses, ce qui impose de consid\u00e9rer que, au-del\u00e0 des principes g\u00e9n\u00e9raux \u00e9voqu\u00e9s, chaque situation devra \u00eatre appr\u00e9ci\u00e9e de mani\u00e8re concr\u00e8te.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nous allons aborder un sujet r\u00e9ellement complexe, qui donne lieu \u00e0 de nombreuses discussions dans le domaine des baux urbains d\u2019habitation : la question de savoir \u00e0 qui incombe la prise en charge du co\u00fbt des r\u00e9parations dans les logements lou\u00e9s.
