{"id":3757,"date":"2021-09-17T09:33:29","date_gmt":"2021-09-17T07:33:29","guid":{"rendered":"https:\/\/gavelsabogados.com\/?p=3757"},"modified":"2025-04-25T13:07:22","modified_gmt":"2025-04-25T11:07:22","slug":"measures-on-electricity-introduced-by-royal-decree-law-17-2021-of-14-september-on-urgent-measures-to-mitigate-the-impact-of-the-rising-natural-gas-prices-on-retail-gas-and-electricity-markets","status":"publish","type":"post","link":"https:\/\/gavelsabogados.com\/en\/measures-on-electricity-introduced-by-royal-decree-law-17-2021-of-14-september-on-urgent-measures-to-mitigate-the-impact-of-the-rising-natural-gas-prices-on-retail-gas-and-electricity-markets\/","title":{"rendered":"Measures on Electricity Introduced by Royal Decree-Law 17\/2021, of 14 September, on Urgent Measures to Mitigate the Impact of the Rising Natural Gas Prices on Retail Gas and Electricity Markets"},"content":{"rendered":"<p class=\"\" data-start=\"504\" data-end=\"738\">On <strong data-start=\"507\" data-end=\"528\">16 September 2021<\/strong>, <strong data-start=\"530\" data-end=\"558\">Royal Decree-Law 17\/2021<\/strong>, of <strong data-start=\"563\" data-end=\"579\">14 September<\/strong>, on urgent measures to mitigate the impact of the increase in natural gas prices on retail gas and electricity markets (\u201c<strong data-start=\"701\" data-end=\"716\">RDL 17\/2021<\/strong>\u201d) entered into force.<\/p>\n<p class=\"\" data-start=\"740\" data-end=\"896\">Among the measures introduced by <strong data-start=\"773\" data-end=\"788\">RDL 17\/2021<\/strong>, the following are summarised below for information purposes only, and are neither exhaustive nor detailed:<\/p>\n<hr class=\"\" data-start=\"898\" data-end=\"901\" \/>\n<h3 class=\"\" data-start=\"903\" data-end=\"934\"><strong data-start=\"907\" data-end=\"934\">1. MINIMUM VITAL SUPPLY<\/strong><\/h3>\n<p class=\"\" data-start=\"936\" data-end=\"1357\">A new <strong data-start=\"942\" data-end=\"960\">Article 45 bis<\/strong> is introduced in <strong data-start=\"978\" data-end=\"993\">Law 24\/2013<\/strong>, of <strong data-start=\"998\" data-end=\"1013\">26 December<\/strong>, on the Electricity Sector, regulating the <strong data-start=\"1057\" data-end=\"1081\">minimum vital supply<\/strong> for vulnerable consumers. This consists of a supply guarantee limited to a <strong data-start=\"1157\" data-end=\"1195\">maximum contracted power of 3.5 kW<\/strong>, for a period of <strong data-start=\"1213\" data-end=\"1227\">six months<\/strong> following the four-month period provided for in <strong data-start=\"1276\" data-end=\"1296\">Article 52.3 LSE<\/strong>, during which supply cannot be suspended due to non-payment.<\/p>\n<p class=\"\" data-start=\"1359\" data-end=\"1454\">The disconnection procedure <strong data-start=\"1387\" data-end=\"1411\">may not be initiated<\/strong> until after these six months have elapsed.<\/p>\n<p class=\"\" data-start=\"1456\" data-end=\"1735\">For the application of the minimum vital supply, the <strong data-start=\"1509\" data-end=\"1527\">retail company<\/strong> shall request its application from the <strong data-start=\"1567\" data-end=\"1591\">distribution company<\/strong>. The reference retail company must send a written notification to the consumer within <strong data-start=\"1678\" data-end=\"1690\">ten days<\/strong> of such request, informing them accordingly.<\/p>\n<p class=\"\" data-start=\"1737\" data-end=\"1883\">The content of the notification letters to be sent to clients under the non-payment procedure established in <strong data-start=\"1846\" data-end=\"1871\">Royal Decree 897\/2007<\/strong> is amended.<\/p>\n<hr class=\"\" data-start=\"1885\" data-end=\"1888\" \/>\n<h3 class=\"\" data-start=\"1890\" data-end=\"1974\"><strong data-start=\"1894\" data-end=\"1974\">2. MEASURES REGARDING THE IVPEE (Tax on the Value of Electricity Production)<\/strong><\/h3>\n<ul data-start=\"1976\" data-end=\"3064\">\n<li class=\"\" data-start=\"1976\" data-end=\"2398\">\n<p class=\"\" data-start=\"1978\" data-end=\"2398\">The <strong data-start=\"1982\" data-end=\"2016\">taxable base for the year 2021<\/strong> is reduced: for fiscal year 2021, the taxable base of the <strong data-start=\"2075\" data-end=\"2084\">IVPEE<\/strong> shall be constituted by the total amount to be received by the taxpayer for the production and incorporation into the electricity system of electricity, measured at the busbar, reduced by the revenues corresponding to the electricity incorporated into the system during the <strong data-start=\"2359\" data-end=\"2397\">third and fourth calendar quarters<\/strong>.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2400\" data-end=\"2712\">\n<p class=\"\" data-start=\"2402\" data-end=\"2712\">The <strong data-start=\"2406\" data-end=\"2429\">instalment payments<\/strong> for the <strong data-start=\"2438\" data-end=\"2455\">third quarter<\/strong> shall be calculated based on the value of electricity produced at busbar during the tax period, reduced by the remuneration corresponding to the electricity incorporated during that quarter, applying the tax rate and deducting any previously made payments.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2714\" data-end=\"3064\">\n<p class=\"\" data-start=\"2716\" data-end=\"3064\">The <strong data-start=\"2720\" data-end=\"2743\">instalment payments<\/strong> for the <strong data-start=\"2752\" data-end=\"2770\">fourth quarter<\/strong> shall be calculated based on the value of electricity produced at busbar during the tax period, reduced by the remuneration corresponding to the electricity incorporated into the system during the <strong data-start=\"2968\" data-end=\"2997\">third and fourth quarters<\/strong>, applying the tax rate and deducting any previously made payments.<\/p>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>On 16 September 2021, Royal Decree-Law 17\/2021, of 14 September, on urgent measures to mitigate the impact of the increase in natural gas prices on retail gas and electricity markets (\u201cRDL 17\/2021\u201d) entered into force.
